Terms and Conditions of Sale (TCS)
PREAMBLE:
These terms and conditions of sale (TCS) have been drafted in full compliance with the consumer code.
REMINDER OF THE LEGISLATION:
It is the responsibility of the buyer to follow their package online using the tracking link provided and to take all necessary measures to retrieve their package and immediately report any anomalies observed to the CARRIER. Any package returned to the seller despite the tracking link provided to the buyer will be considered a withdrawal (except in case of guarantee).
I - DELIVERY OF PARCELS:
I-1: Delivery Method:
All orders are shipped as tracked parcels: A tracking link is sent by email to the buyer as soon as the product is shipped. To remind, it is the buyer's responsibility to follow their package online using the provided tracking link and to take all necessary measures to retrieve their package and immediately report any anomalies observed to the carrier. In the event of a dispute, the buyer can request proof of delivery from the seller. This proof (provided by the carrier) aims to prove the good faith of the seller and the shipping of the parcel to the address provided by the buyer. This document can be signed by the carrier or a third party, as the tracked parcel is not a parcel delivered against a signature.
I-2: Delivery to a Relay Point:
The law allows all carriers to drop off parcels at a post office or relay point for any reason to prevent them from being stolen or lost. This information will be indicated on your parcel tracking, by clicking on "identify the relay point." The display of the relay point will be active until the parcel is delivered to the buyer (indicated as delivered) or during the legal retention period of parcels, which is 7-10 days maximum. After this period, the address of the relay point will no longer be visible, and the package will be returned to the sender at the buyer’s expense. These costs will then be deducted from any possible refund.
I-3: Product Not Retrieved:
In accordance with the legislation, any ordered item that is not retrieved by the buyer (despite the tracking link provided to them) or cannot be delivered by the carrier due to a wrong address, an incomplete address, an absence, or any other reason WILL BE RETURNED TO THE SELLER after 7 days at the buyer's expense (HAMON LAW).
I-4: Delivery Delays:
The delivery times displayed are the usual times announced by the carriers. They are not contractual but cannot exceed 30 days. We cannot be held responsible for delays caused by carriers, especially during peak periods such as Christmas, Valentine’s Day, etc., or during strikes or bad weather. Any claim following a late delivery will be refused.
I-5: Order Indicated as Delivered but Not Received:
If the parcel tracking indicates "delivered" but you have not received it, you have 48 hours to report the non-receipt of the parcel to the seller. The seller will then request an investigation from the carrier.
IMPORTANT REMARKS:
- The seller cannot be held responsible if the buyer has not followed their parcel.
- The seller cannot be held responsible if the buyer does not respond to any delivery incident mentioned in the parcel tracking.
- The seller cannot be held responsible if the buyer does not inform within 48 hours if the tracking indicates that the parcel has been delivered but the buyer claims not to have received it.
I-6: Refused Parcel:
Any refused parcel is considered a withdrawal. The return of the parcel will then be under the buyer's responsibility. The return costs will then be borne by the buyer (HAMON LAW).
I-7: Order Cancellation - Address Change:
An order is considered as firm and definitive as soon as the buyer clicks on the "order" button and the payment is accepted. Order processing is done automatically, and this procedure cannot be stopped. Cancellation or an address change is therefore no longer possible.
II Terms and Conditions of Return (Hammon Law)
Return shipping costs are always borne by the buyer. (HAMON LAW).
- The refund is processed within a maximum of 14 days after receipt and inspection of the package by the seller.
- In the case of traces of use of the product, incomplete return, or any incident preventing the product from being resold as NEW, we reserve the right to charge for reconditioning or to refuse the refund.
- In this case, the product will be returned to the buyer at their expense. If the buyer refuses, the product will be destroyed within 30 days without any compensation for the buyer.
- Since product returns are under the responsibility of the buyer, no refund will occur if the product arrives damaged at the seller.
III - WARRANTY & NON-CONFORMITY:
For products coming from abroad, the seller cannot organize return slips or collect products from relay points.
III-1: Non-Conformity:
A product is considered non-conforming if it does not match the description of the ordered product. (https://www.service-public.fr/particuliers/vosdroits/F11094): A product is non-conforming in the following situations:

- The item is unsuitable for the use usually expected of a similar item (e.g., a product typically intended to operate wirelessly on battery must be plugged into the mains, frequent failures, missing functions...).
- The item does not match the description provided by the seller even if it works perfectly. For example, the color does not match the displayed model.
- The item does not have the qualities announced by the seller or agreed upon with you (e.g., an extractor hood presented as particularly quiet turns out to be noisy).

- A product received damaged during transport is not considered a non-conformity! (Articles L216-4, L216-5, and L. 224-65 of the Consumer Code)

III-2: Product Received Broken:
The seller is responsible for the proper execution of the contract and a compliant delivery. However, in the case of a product received damaged during transport, it is crucial to determine the origin of the damage:

- Damage caused during transport?
- Damage occurring after the receipt of the package (dropped during unpacking, etc.)?

For this, the Consumer Code specifies: According to Article L216-4 of the Consumer Code, any risk of loss or damage to goods is transferred to the consumer when the latter or a third party designated by them, other than the carrier proposed by the professional, physically takes possession of these goods. The buyer has 72 hours after the receipt of the package to report the damage to the CARRIER with a registered letter. This period extends to a maximum of 10 days if the package was not handed over directly to the buyer. After this period, the carrier’s responsibility cannot be engaged, and the damage must be considered "an accident due to the buyer's negligence". In this case, the warranty cannot apply, and the seller's responsibility is not engaged.
III-3: 24-Month Warranty on All Products
The product must be returned CLEAN with all accessories and instructions, and ideally in its original packaging. The product must be returned in additional packaging (e.g., the one used for shipping). Note: If the product is found to be in perfect working order, it will be returned to the buyer at their expense. In the case of the buyer's refusal, the product will be destroyed within 30 days without any compensation for the buyer. If the product has a manufacturing defect, the return shipping costs will be refunded to you. Warranty application: The refund amount for return costs cannot exceed the amount initially charged by the seller for shipping the package (maximum amount = outbound shipping costs). Product refunds are processed within a maximum of 14 days after receipt and inspection of the package by the seller.
IMPORTANT REMARKS:
The warranty does not apply to:

- Damages involving the responsibility of a third party or resulting from an intentional or fraudulent fault.
- Damages resulting from using energy, employment, or installation not conforming to the manufacturer's specifications or negligence.
- Replacement of accessories (such as: filters, vacuum cleaner brushes and hoses, ...), replacement of batteries, bulbs, tubes, and lamps of overhead projectors and video projectors, and all presentation parts not hindering the proper functioning of the device.
- Damages resulting from oxidation (e.g., mobile phone, camcorder, digital camera, etc.).
- Antenna failures, connection or commissioning errors.
- Damages resulting from commercial, industrial, artisan, or liberal use.
- Damages resulting from an external cause such as shock, fall, lightning, fire, water damage, storm, or vandalism.
- Batteries and cells included in products (watches, mobile phones, etc.).
